The Court of Appeal sitting in Enugu, Enugu state has upheld the election of Engr. David Umahi of the Peoples Democratic Party (PDP) as the governor of Ebonyi State in the April 11general elections.
The election petition tribunal headed by Justice Theresa Igoche had in October this year in Abakaliki dismissed the petition filed by Chief Edward Nkwegu of the LabourParty (LP), challenging the declaration of Chief Umahi as the winner of the election by the Independent National Electoral Commission (INEC), for lack of merit.
Dissatisfied with the judgment of the tribunal, Chief Nkwegu proceeded to the appellate court in Enugu to challenge the verdict.
The petitioner through his counsel, Chief U.N Udechukwu (SAN), had prayed the appeal court to set aside the judgment of the tribunal on nine grounds which he said made the verdict a grave error of law.
But the nine grounds were dismissed in a judgment delivered by a three man appeal court panel led by Justice A. O. K Oyewole for lack of merit.
