Alleged forgery: ex-Rep Ozomgbachi, 2 PDP chieftains for trial, Dec 9

A former member of the House of Representatives, Hon. Ogbuefi Ozomgbachi and two other members of the Peoples Democratic Party (PDP) in Enugu state, will on December 9, 2015 enter the dock at the Enugu State High Court for allegations of conspiracy, forgery, impersonation and perjury.

Ozomgbachi, who represented the Udi/Ezeagu Federal Constituency for 12 years from 2003 to 2011, is being charged with two other chieftains of the PDP in the state, Mr. Paul Anikwe (55) and Mrs. Ifeyinwa Ozoani (54), who are alleged to have conspired to forge a document purportedly emanating from a former acting chairman of the PDP in the state, Elder David Ajah.

In charge No: E/117c/2015, a matter between the Commissioner of Police and the three accused persons, instituted before the Enugu State High court on 27th October, 2015, the three persons are facing four count charges ranging from felony, to wit forgery, punishable under Section 495 (a) of the Criminal Code Act. Cap. 30 Revised Law of Enugu State 2004.

In the four count charge, Hon. Paul Anikwe and Hon. (Mrs) Ify Ozoani were accused of having separately made false documents in letters dated 6th December 2014, where they claimed they were appointed electoral and returning officers, respectively, for the House of Representatives primary election of the PDP on 6th December, 2014 for Udi/Ezeagu Federal Constituency and purporting same to have been signed by Elder David Ajah, a former acting Enugu State chairman of the PDP.

One of the count charges reads: “That you Hon. Ogbuefi Ozomgbachi (m), at the afore-stated time, place and date in Enugu, in the Enugu Judicial Division did make a false document, to wit, a document purporting to be the PDP National Assembly Primary Election 2014 Result Sheet for the House of Representative Primary Election for Udi/Ezeagu Federal Constituency (0000318) wherein you purported yourself to be as the winner of the Udi/Ezeagu Federal Constituency, House of Representatives Primary Election held on the 6th day of December at the Udi Local Government Headquarters, Enugu, knowing same to be false, and with intention that it be used as evidence in a Court of Justice in Nigeria and thereby committed an offence punishable under section 443 (5) (e) of the Criminal Code Law cap. 30 revised Law of Enugu State 2004.”

Another member of the House of Representatives, Dr. Patrick Asadu for Nsukka/Igboee South Federal Constituency is facing similar accusations of forgery of results in a petition by another contender for the PDP ticket for the seat, Mr. Ikechukwu Ugwuegede, who claims to have won the primary election of the party.

The Enugu State Police Command in the report of its investigations indicted Dr. Asadu, threatening to arraign him in court for alleged forgery. But Dr. Asadu accused the police of bias, saying the matter is already pending before the Supreme Court. (The Easterner, Leadership)
